JOHANNESBURG — The South African political landscape was sent into a tailspin last week following the landmark sentencing of Economic Freedom Fighters (EFF) leader Julius Malema. After a protracted legal battle dating back to 2018, the East London Magistrate’s Court has sentenced the “Commander-in-Chief” to five years of direct imprisonment
The conviction stems from the 2018 incident at the Sisa Dukashe Stadium in Mdantsane, where Malema was filmed discharging what the court ruled was a real assault rifle during the EFF’s fifth-anniversary celebrations.
While Malema remains free on warning pending an appeal, the political repercussions are already vibrating through the halls of Parliament and the EFF’s “Winner’s Park” headquarters
What Happens to Malema’s Seat in Parliament?
The immediate question for many is whether Malema can continue to serve as a Member of Parliament (MP). The answer lies in Section 47(1)(e) of the Constitution of South Africa.
Under this provision, any person who is convicted of an offence and sentenced to more than 12 months’ imprisonment without the option of a fine is disqualified from being a member of the National Assembly. Because Malema’s five-year sentence far exceeds this threshold, his disqualification is a legal certainty—but there is a catch.
The disqualification only takes effect once the appeal process has been exhausted. By successfully applying for leave to appeal both his conviction and sentence, Malema has effectively hit the “pause” button. He will likely retain his seat in the National Assembly for months, if not years, as the case winds its way through the High Court and potentially the Supreme Court of Appeal.
However, should the higher courts uphold the five-year term, Malema would not only lose his seat immediately but would also be barred from returning to Parliament for five years after his sentence is completed.
The “Red Berets” Without a Leader?
For the EFF, Malema is more than just a leader; he is the party’s central identity. The prospect of his incarceration presents the greatest existential threat to the party since its founding in 2013.
- Leadership Succession: In the event of Malema’s imprisonment, the mantle would officially fall to the Deputy President, Floyd Shivambu. While Shivambu is a master strategist, he lacks the populist charisma that has made Malema a household name.
- The “Political Lawfare” Narrative: The EFF has already begun framing the sentence as a “politically motivated hit” orchestrated by the ruling ANC and the “white monopoly capital” interests represented by groups like AfriForum. This narrative is likely to be the party’s primary mobilization tool heading into the next election cycle.
- Internal Stability: Malema has historically maintained a tight grip on party discipline. Analysts suggest that a “power vacuum” at the top could lead to factionalism within the EFF’s provincial structures, which have long been held together by Malema’s personal authority.
What’s Next for the Firebrand?
Malema’s legal team, led by Advocate Lawrence Hodes, has argued that the sentence is “harsh and disproportionate,” especially given that no one was physically harmed during the 2018 incident.
In the court of public opinion, Malema remains defiant. Addressing supporters outside the court on April 16, he characterized the judgment as a “temporary setback in the long walk to economic freedom.”
For now, the “Red Berets” are in a state of high-stakes limbo. If the appeal fails, South Africa could see its most prominent opposition voice trading his signature red overall for a prison uniform—a move that would fundamentally redraw the map of South African politics.
