CAN YOU IMAGINE: THE FAKE LAWYER THAT DEFEATED TRAINED AND EXPERIENCED LAWYERS IN THE COURTROOM!

Imagine trying to log into your own professional account only to discover someone else has been living out your career better than you! Strange things are happening in this world!

That was the bizarre situation involving Kenyan lawyer Brian Mwenda Ntwiga. After being admitted to the bar in August 2022, Ntwiga went to work at the Office of the Attorney General. Because of his government role, he didn’t require a standard practicing certificate, leaving his Law Society of Kenya (LSK) online portal inactive. It was the perfect digital real estate for a highly unusual identity heist.

Enter Brian Mwenda Njagi.

According to investigations, Njagi allegedly utilized a “Business Email Compromise” tactic, reaching out to the LSK to claim his system email address was incorrect. Once the system administrators updated the contact info, Njagi locked the real lawyer out, uploaded his own photo, and effectively became an Advocate of the High Court of Kenya! Just like that!

The impostor then reportedly appeared in court for over a year, standing before magistrates and High Court judges. Local media and the internet quickly exploded with claims that the untrained imposter had won all 26 of the cases he took on. All the cases were contentious and won against trained and experienced Lawyers! WOW!

The Law Society of Kenya, however, swiftly shut down the applause. They branded Njagi a dangerous “masquerader” and a criminal who posed a serious threat to the justice system. In September 2023, the real Ntwiga finally tried to log in, realized he was locked out, and alerted authorities. Njagi was subsequently arrested by the LSK’s Rapid Action Team and charged with six criminal counts, including forgery and identity theft. The story goes that our fake lawyer provided such a robust defence that he got acquitted and discharged!

Social media, as expected, had a field day. While the LSK dealt with the fallout, sections of the public turned the accused into a folk hero. Kenya’s Central Organisation of Trade Unions (COTU) praised him as a “brilliant young mind” who overcame traditional barriers. Controversial former Nairobi governor Mike Sonko even stepped in to back him, calling critics “nincompoops” and claiming Njagi was his “future lawyer”. Can you beat that!?

Some joked that he deserved an honorary law degree for “learning on the job,” while others wondered how an entire legal ecosystem could allow such a mix-up in the first place.

One thing is certain: this story is a jarring reminder that even the strongest passwords can’t protect an infrastructure if the human verification checks fail!
